1. Acceptance of Terms

By accessing or using the FlutterSDK website (fluttersdk.com), applications, frameworks, tools, or any other services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms that may apply to specific features or services.
1.2 Eligibility
You must be at least 16 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
1.3 Modifications
FlutterSDK reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our Services.
2. Description of Services
FlutterSDK provides a unified ecosystem for Flutter application development, consisting of four main pillars:
2.1 Frameworks (Open Source)
- Magic: A full-stack application framework for Dart/Flutter
- Wind UI: A utility-first styling library for Flutter
These frameworks are provided under open source licenses (MIT) and are governed by their respective license terms in addition to these Terms.
2.2 Intelligence & Creation (SaaS)
- FlutterSDK AI: AI-powered code generation and assistance tools
- FlutterSDK Editor: Browser-based IDE and preview environment
2.3 Infrastructure (Cloud Services)
- FlutterSDK Cloud Kit: Backend-as-a-Service and DevOps platform
- Edge Functions: Serverless computing capabilities
- Deployment Pipeline: Automated build and deployment services
2.4 Community
- Flutter Jobs: Job board for Flutter developers
- Flutter News: Curated Flutter news and content
- FlutterSDK Academy: Educational content and courses
3. User Accounts
3.1 Account Registration
To access certain features of our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Promptly update your information if it changes
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Account Termination by User
You may terminate your account at any time through your account settings. Upon termination:
- Your access to the Services will be revoked
- Your personal data will be deleted or anonymized in accordance with our Privacy Policy
- Any remaining subscription periods are non-refundable except as provided in Section 6
3.3 Account Termination by FlutterSDK
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, illegal, or abusive conduct
- Non-payment of fees
- Extended periods of inactivity
- Actions that may harm FlutterSDK or other users
4. User Conduct and Responsibilities
4.1 Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our Services
- Use automated tools to access or scrape our Services without permission
- Impersonate any person or entity
- Engage in any activity that could damage, disable, or impair our Services
4.2 User Responsibility
YOU ARE SOLELY RESPONSIBLE FOR:
- All content you create, upload, or transmit through our Services
- All applications and code you develop using our frameworks and tools
- Ensuring your use of our Services complies with applicable laws
- Backing up your own data and code
- The security and confidentiality of your account credentials
FlutterSDK is not responsible for any losses, damages, or liabilities arising from your use of our Services or the applications you create.
5. Early Access and Beta Programs
5.1 Program Participation
FlutterSDK may offer early access or beta programs ("Beta Programs") for pre-release features, services, or products. Participation in Beta Programs is:
- By application only, at FlutterSDK's sole discretion
- Subject to these Terms and any additional Beta Program terms
- Limited to specific features or services as designated by FlutterSDK
5.2 Beta License
If accepted into a Beta Program, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and test the pre-release features
- Use the features solely for evaluation and testing purposes
- Provide feedback and bug reports to FlutterSDK
5.3 Beta Restrictions
You agree NOT to:
- Use Beta features for commercial production purposes
- Share, distribute, or disclose Beta features to third parties
- Capture screenshots, recordings, or documentation of Beta features without permission
- Reverse engineer, decompile, or attempt to derive source code from Beta features
- Share your Beta Program access credentials with others
5.4 Disclaimer of Warranties for Beta
BETA FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
You acknowledge and agree that:
- Beta features may contain bugs, errors, and defects
- Beta features may not perform as expected or as described
- Beta features may be modified, suspended, or discontinued without notice
- Data processed through Beta features may be lost or corrupted
- Beta features are not suitable for production use
- There is no guarantee that Beta features will be released as final products
5.5 Feedback and Intellectual Property
By providing feedback, suggestions, bug reports, or ideas related to Beta Programs or any Services ("Feedback"), you:
- Grant FlutterSDK a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the Feedback
- Waive any moral rights in the Feedback
- Acknowledge that FlutterSDK is under no obligation to implement any Feedback
- Acknowledge that you will receive no compensation for Feedback
5.6 Beta Termination
FlutterSDK may terminate your participation in any Beta Program at any time, for any reason, without notice or liability. Upon termination:
- Your access to Beta features will be immediately revoked
- You must delete any Beta materials in your possession
- No refunds will be provided for any Beta-related fees
6. Fees, Payments, and Refunds
6.1 Pricing
FlutterSDK offers both free and paid Services. Fees for paid Services are displayed at the time of purchase and are subject to change with notice.
6.2 Payment Terms
For paid Services:
- Payment is due at the time of purchase or at the beginning of each billing cycle
- All fees are exclusive of taxes unless otherwise stated
- You are responsible for all applicable taxes
- We may suspend Services for non-payment
6.3 Refund Policy
FlutterSDK's refund policy is determined at FlutterSDK's sole discretion, based on the following factors:
6.3.1 Service-Specific Costs
Due to the nature of our cloud-based services (including AI processing, server infrastructure, and compute resources), FlutterSDK incurs costs for your usage that may not be recoverable. Therefore:
- Consumed Services: Fees for AI processing, server usage, compute time, API calls, and other consumed resources are generally non-refundable once the service has been rendered.
- Subscription Fees: Unused portions of subscription periods may be eligible for partial refunds at FlutterSDK's discretion, prorated based on the remaining period.
- One-time Purchases: May be refundable within 14 days of purchase if the service has not been substantially used.
6.3.2 EU Consumer Rights
If you are a consumer in the European Union, you have a 14-day statutory right of withdrawal for certain digital services. However, you acknowledge that:
- By using the Services immediately after purchase, you may waive your withdrawal right
- Consumed services cannot be "returned" and are thus non-refundable
- This does not affect your statutory rights for defective services
6.3.3 Refund Requests
All refund requests must be submitted to [email protected] with:
- Your account information
- The service in question
- Reason for the refund request
- Any relevant documentation
FlutterSDK will review each request on a case-by-case basis and respond within 14 days.
6.4 Free Services
Free Services are provided without warranty and may be modified, limited, or discontinued at any time without notice.
7. Intellectual Property
7.1 FlutterSDK Ownership
ALL RIGHTS RESERVED.
FlutterSDK and its licensors retain all right, title, and interest in and to:
- The Services, including all software, technology, and infrastructure
- All trademarks, service marks, logos, and brand elements
- All content, designs, graphics, and user interfaces
- All documentation, specifications, and materials
- All patents, copyrights, trade secrets, and other intellectual property rights
Except as expressly granted in these Terms, no right, title, or interest in any FlutterSDK intellectual property is transferred to you.
7.2 Open Source Software
Certain components of our Services (Magic, Wind UI) are provided under open source licenses. Your use of open source components is governed by the applicable open source license terms, which may permit uses not otherwise authorized by these Terms.
7.3 User Content
You retain ownership of content you create or upload to our Services ("User Content"). By submitting User Content, you grant FlutterSDK a non-exclusive, worldwide, royalty-free license to use, store, display, and process your User Content solely to provide the Services to you.
7.4 Copyright Infringement
We respect intellectual property rights. If you believe content on our Services infringes your copyright, please contact us at [email protected] with the relevant details.
8. Disclaimers
8.1 "As Is" Provision
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by law, FlutterSDK disclaims all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of content
- Uninterrupted, timely, secure, or error-free operation
- Freedom from viruses or other harmful components
8.2 Third-Party Services
Our Services may integrate with or link to third-party services. FlutterSDK is not responsible for and makes no warranties regarding any third-party services, content, or practices.
8.3 No Professional Advice
Nothing in our Services constitutes professional advice (legal, financial, technical, or otherwise). You should consult appropriate professionals for specific advice.
9. Limitation of Liability
9.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUTTERSDK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Cost of procurement of substitute services
- Any damages arising from your use or inability to use the Services
- Any damages arising from unauthorized access to your account or data
- Any damages arising from applications you develop using our Services
- Any damages arising from third-party conduct or content
THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF FLUTTERSDK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2 Liability Cap
FLUTTERSDK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF:
- The total fees you paid to FlutterSDK in the twelve (12) months preceding the claim, or
- One hundred euros (€100)
9.3 Essential Purpose
You acknowledge that the limitations of liability in this section are essential elements of the agreement between you and FlutterSDK, and that FlutterSDK would not provide the Services without these limitations.
9.4 Exceptions
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by applicable law
10. Indemnification
You agree to indemnify, defend, and hold harmless FlutterSDK and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Your User Content
- Applications, products, or services you develop using our Services
- Any dispute between you and a third party relating to the Services
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
11.2 Jurisdiction
Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Germany.
11.3 EU Consumer Rights
If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
11.4 Informal Resolution
Before initiating formal dispute proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and FlutterSDK regarding the Services.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
12.3 Waiver
Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without FlutterSDK's prior written consent. FlutterSDK may assign its rights and obligations without restriction.
12.5 Force Majeure
FlutterSDK shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
12.6 Notices
